8. They both are almost same things, and have the same power or effect. The main difference is that the easement is arised generally in private sectors, while the right of way arises in public sectors. Govt. grant right of way in public sectors while an indivisual or courts grant the easement.

The est example of right of way is the roads, which govt. grant to the road construction companies for constructing the roads. On the other hand easement deals in private sectors, and it can be negative and positive. A positive easment holder has the right to do something over someone\'s else\'s land, while a negative easement over a property may restrict of doing something something on your land. For example, you can not construct high rise buildings if it is obstructing the view of a building from a land. Or building high rise buildings in earthquake zone IV is not allowed.
