Executive Summary of \"Whose Line Is It Anyway\"

Since the time of early civilization, humankind has had problems with demarcating boundaries. Back then the problem was more to do with shifting markers for such demarcations but in today\'s age the problems are more complex. Surveyors\' surveys may suggest markers be placed on either side of the existing boundaries leading to disputes and litigations. Lawyers for one are ever ready to litigate but all this costs the parties a lot of money, their time and the benefits so derived seemed dwarfed by the resources so deployed and to add to it is the ill will that all this brings about.

Under conducive circumstances, a formal boundary line agreement can be quickly drawn out that is without the professional strappings and costs thereof. The parties agree to the mutually agreed boundary line and place the markers accordingly.

However there are other situations that need to be discussed that one has to deal with to fully understand this issue.

Implied Boundary Line Agreements: The private parties herein recognize the fact that the true boundary line is difficult to trace or establish as standard surveying practices cannot determine the same. The parties may herein formally agree to have boundary markers for an extended period of time (more than the period of adverse possession) that may not be defined exactly.

The principle of \'estoppel\' is also applied for implied boundary lines. Herein the conduct of the parties to a boundary situation canot be capricious. Should the parties have had an understanding over an extended period of time over the boundary existing between the properties then it cannot be challenged by one at a later date especially if that were to the detriment of the other.

Humankind by their very nature are possessive and over time it has been seen that formal agreements in place help in staying away from litigations which not only benefit the present owners but also provide for future owners to enjoy their possession in peace..
