According to the criteria used by court these installers and technicians were independent contractors and not employees. The court used the ABC test for analysing the case.
Free from direction and control : The court found that the company did not have any right to direct or control the work of these installers and technicians. These installers and technicians performed work at customers home and they were not monitored by the company, they used their own materials and transportation and were free to accept ot reject any assigned job.
Outside the usual course or place of Business of the employer : The court told that customers place cannot be the place of business under part b of the test.
