Why do you think that the judge describes a certain approach to verbal contracts as \"common sense\" and what is that approach?

Solution

Agreements can be written or verbal. Written agreements are in writing and detailed terms and conditions are agreed upon on paper and documented. Verbal agreements are word of mouth and implied. For example, A agrees to deliver B three boxes of oranges for consumption for which B will pay money on the delivery. It is implied that the oranges are to be in good and edible condition when delivered to B. Verbal agreements can be enforceable by law. To help the case evidences of emails, chats, call records or third party independent witness can be presented before the judge. In case of lack of evidence the judge/s take the common sense approach according to the credibility of the parties involved and reach for the appropriate terms of the verbal agreements.
