What is it about the use of depositions and interrogatories
What is it about the use of depositions and interrogatories that you believe cause the discovery process to be such an expensive one for businesses?
Let\'s say you are on Spring Break vacation in Florida. As you are crossing the street, a drunk driver runs the red light and hits you as you are in the crosswalk. You are injured and lose a leg. When you finally get out of the hospital, you return to your home and contact your local attorney about filing a lawsuit against the drunk driver. She tells you that you have to sue the driver in Florida, even though that is thousands of miles from where you live. Is she right? Is that fair? Why? Hint** Is is a jurisdiction issue!
Solution
The interrogatories are considered as the part of the discovery process which is conducted before the trial. Since the interrogatories are taken under oath it has specific values. It is taken through sending the questionnaire by the lawyer to the individual and he has to respond to it within specific time.
The dispositions are also taken under oath where the lawyers questions both sides, all witnesses. Since the outcome of the interrogatories and the dispositions are referred by the courts while providing judgment it is considered to be valid and costly for the parties indulged in the case.
When considering the accident incident, since the accident has occurred at Florida, the case has to be filed in the court located at Florida as per the legislations and jurisdictions. The courts can handle the cases which have occurred within its geographical limits.
But when the situation of the victim is considered who has lost his legs, it is not ethical and fair to make him to travel or relocate to Florida for claiming against his loss.
