3. Why has the notion of states\' rights continued to be an issue of some controversy in the American system?
Solution
The founder fathers of the American constitution planned for the most of the power to be kept with the states instead of having them with the Federal government. It was believed by these founders that a supreme Federal government would encroach upon freedom of the states and will lead to despotism. But unfortunately the existent annihilation of state\'s rights started with the Civil War and has developed exponentially since and can be evidently seen in the number of unfunded mandates placed by the Federal government on the states. It is for this reason it was recognized by the framers of the constitution the need for some central structure with limited powers for very explicit functions which otherwise could not be delivered by the states.
