3. (TCO A) Oscar Itoldi works as a janitor in the By-the-Sea nuclear reactor plant, which is privately operated by the Shorelite Energy Company. He has complained for the past three years that strange odors are present on occasion in different areas of the basement, but usually near an exhaust pipe. He notices that he is sick more often and that others have complained of headaches. He also knows that management has cut corners in regards to the proper disposal of hazardous materials. He complains again to his supervisor, but this time he also says that he will contact the proper authorities if the odors are not eliminated, and that he knows all of the ways of getting around the rules. The next day, he is terminated for insubordination. If you were Oscar, under what theory would you challenge your termination? Why?

Solution

As Oscar I would challenge my termination on the basis of whistle blower act. This act ensures that if there is something wrong happening in a company and you rise against it and company take some harass action against you in order to cover your voice against certain issue. One can go with the law and ask the court to solve the problem. In this case as Oscar was terminated without any prior notice for reason not obeying order of seniors he can challenge it in court. For evidence he can give the areas where odors use to come in the company. As the company is also not in ethical business of proper disposal of hazardous material we can also bring it as evidence in court. In case it is also given that few other employees also face problems regarding their health issues they can be also used as evidence. The medical reports of Oscar for past 3 years can be also used as evidence and if he has any complain in written regarding this issue can be used as evidence
