A civil case in which either a criminal case resulted in a s
A civil case in which either a criminal case resulted in a subsequent civil case for damages, or a civil case resulted in subsequent criminal charges.
Solution
In ordinary situation, a criminal lawsuit and civil lawsuit are two different things and basics are somewhat different, and civil disputes usually involve money, and criminal acts.
A civil lawsuit involves two or more civilians , while criminal lawsuit involves the law. While not impossible , it is unlikely that a civil lawsuit would turn into a criminal , unless given special circumstances.
Further, crimes can be committed during a civil lawsuit (e.g. Perjury, contempt etc) that can result in criminal charges. If crimes are confessed to during a civil trial , criminal charges could be filed. However a civil trial would not transform itself into a criminal trial.
Furthermore, it happens the other way a lot, Most famous was i a famous case , he was found innocent by a jury of the criminal charges of murdering Nicole Brown and Ronald Goldman. Then the family of Ronald Goldman sued him civilly for wrongful death and assault of Ronald Goldman. Goldman family ended up winning that civil case and were awarded money of 33,500,000 dollars in damages. This is known as OJ case in short, i.e OJ Simpson.
Anything verdict in a civil case is inadmissible in a similar case. This because the standards are a lot lower civil cases than in criminal cases. There can be both a criminal and civil case for things like assault, fraud, rape or even murder, but the cases are tried separately and can easily have different outcomes.
However it often advisable to let the STATE prosecute for criminal charges first, IF they can get a conviction , you can use that in your civil case (since the standards of a criminal case are higher than a civil case) and it makes things a lot easier win, or most likely settle out of court, and even if they cannot get a conviction like OJ case, the standard in a civil case is much lower and still have a chance of winning there.
So it depends on circumstances and it is possible in the legal world.
