The paint removers, rubber cements and all other consumer products containing the chemical benzene is banned in the U.S. by CPSC.
1. I agree with the reason of ban of the products because these products possess the serious health hazards. The benzene in the product cause the cancer with the human White blood cell and also cause the genetic disorder.
2. The Congress told the CPSC to do in its enabling act as publish with the Federal Register with the effective dates on which the comments would be solicited. This act states that the Prohibition on all the products that uses the benzene present as an unintentional impurity in concentrations of 0.1 percent or greater.
3. This enabling act a clear enough mandate to guide the Agency because it clearly stated the quantity used in the product. It is also cleared from the statement that if the benzene is used in the product as an ingredient.
4. The Congress can limit the CPSC acts beyond the scope of its powers. It can issue a notice to the CPSC when ever the CPSC decision effects the business and people or it is not appropriate. The enabling act cannot be passed without the decision of Congress.
An effected business can complain to the higher administrative power. They can have to have the evidence regarding this issue.
