Some people say the staffing process is overregulated in the United States. Do you agree or disagree with this position?
Solution
Yes I do agree with the statement. Staffing process is overregulated in America. For an example if a company has 50 or more than 50 employees then it is compulsory for it to give them health insurance. If the employer is not providing the health insurance then the American government impose huge penalty on the employer. And if the employer is giving the, health insurance then the government gives some subsidy to the company but the burden is heavy on the company.
Because of these laws and regulations the companies are not hiring the candidates as an employee but as a contractor. If they are hiring as an employee then taxes are paid by the employers like Medicare taxes, social security taxes etc but if they are hiring a contractor then employees pay on their own. These are the laws affecting the hiring process of the company.
There are other laws like discrimination law, work hour laws, hiring and firing law etc. The companies are supposed to adhere to it. For an example if we talk about the law regarding overtime wages then if the employee is working more than 40 hour in a week the employer has to pay the employee more than one and half time more than the hourly rate. These all laws have impact on staffing issues.
