To what extent should Internet Service Providers be held liable and accountable for the use of their equipment?
Solution
The ISP are accountable in three ways by the users of its equipment :
- Directly Liable : this is applicable when any ISP subscriber/user makes an infringement of copyrights of others material without permission
- Secondary liability : applicable when the ISP still provides means for the subscribers who try to infringe the copyrights/ any material on internet. actually should close all possible ways that may encourage this activities.
this of two types : vicarious & contributory
- Vicarious liability : applicable when ISP encourages subscribers to do infringment kind of activities by taking financial advantage and providing them access to all others material without permission.
- contributory liabilty : owners of material are liable for giving the exercise of copyrights to other third patry people which caused the infringement activity to happen
ISP is liable by direct , secondary and vicarious only
