8. What are advance directives? (LLO #1)
9. Describe how a living will differs from a durable power of attorney for health care. (LLO #1)
Solution
6.The deal with dignity Act was passed in the state Oregon for the first time. Oregon’s Deal with Dignity Act allows terminally ill Oregonians to end their lives by taking lethal medications prescribed by a physician for that purpose. Death with dignity Act states that terminating one’s life under this law cannot be considered as suicide as the patient prefer to live but the death is certain in a small period of time. The Oregon health authority needs to collect information regarding the patients and physician who participate in the act and publish in its annual statistical report.
7. The purpose of Patient Self Determination Act is to inform the patients regarding their right to take decisions on healthcare matters and protect those rights. Patient Self Determination Act is a federal law that ensures these rights.
8. Advance Directives are the legal documents that help to express the patient’s wishes regarding the type of treatment he wants. It also helps to appoint a person whom the patient trust as his healthcare agent and take medical decisions on behalf of the patient. Advance Directives are legally valid throughout US and are helpful in the case of medical emergency situations where the patient is not able to take decisions on his behalf.
9. A living will is a written document that provides directions on the preferences of the patient regarding their end of life care when the patient is incapacitated. A living will does not appoint anyone on the patient’s behalf to take medical decisions. But a durable power of attorney appoints an agent to take healthcare decisions on his behalf and that makes a living will different from the durable power of attorney for health care. A living will cannot cover all the circumstances but a durable power of attorney can cover all the situations including the ones that are not covered by the living will.
