Halbman a minor bought a used oldsmobile from Lemke an adult
Halbman, a minor bought a used oldsmobile from Lemke (an adult). About five weeks after the purchase and after Halbman had paid $3,100 of the $4,250 purchase price, the connecting rod in the engine broke. Halbman, while still a minor, disaffirmed the purchase contract and demanded all the money he had paid defendant. Is he entitled to a full refund even though the car is now damaged?
Solution
Ans:
According to my view as the sales transaction has completed, payment also done, five week after this the connecting rod in the engine broke and even the car is full damage which might be an accident ( Un predictable)
Still Halbman is not entitled to get any refund. With an excuse of minor he is not allowed to misinterpret the law.
