Dylan may recover the cost of repair if Bette failed to act as  a blameless person.  a faultless person.  a professional person.  a reasonable person.  an innocent person.  Duffy is a passenger in a car that Smith is driving when an accident occurs. Both Smith and Duffy are emotionally rattled, but neither is physically hurt. Smith is not liable to Duffy on a negligence theory because  both parties were emotionally rattled.  Smith and Duffy are friends.  Smith apparently did not intend to cause an accident.
