Describe the major portions of the stages of the trial.
Solution
The trial process can be divided into fout main stages:
(1) Pleading stage: Complaint filing the complaint and the defense\'s motions.Filing a complain is a formal document submitted to the court having jurisdiction. After complain filing summons is issued by a court.the summons typically requires a response with in a 30 days. Defense\'s response or answer to the complaint is known as Motion to Dismiss. Following the defendants response to the plaintiffs claims, the parties can either choose to settle or request a judgment based on the evidence presented, or the court can decide to continue toward resolving conflict at trial. This is known as Motion for Judgment.
(2) Pretrial Stage: This stage is known as discovery or fact finding stage. In this stage, series of questions or sworn testimony , known as deposition is executed outside the courtroom before a court recorder with opposing counsel ask questions of the witness. At the end of discovery,the court will typically review the facts of the case and determine if there is sufficient merit to proceed to trial or to encourage the parties to settle. If the finding of facts determines the case to be frivolous or non-substantiated, the case is dismissed. This process is known as motion for summary judgement. If a substantial basis for the case is determined, the court will meet with and notify the parties of the trial schedule. This is known as pretrial order.
(3) The Trial: From the pool of potential juror, impartial juror is selected in the presence of judge and cousel.
(4) Post- trial stage: The party that the court ruled against has the right to file an appeal for the case to be heard in a court at a higher venue. This is known as Appeals.
