The legal issue here is whether jobs could be given in 108 companies in Newark on the basis of racial classification. The court hold that it cannot be done. Jobs could not be given by keeping racial classification as one of the criteria. It will also violate the Equal Protection Clause of Constitution.
If this clause would have been argued under Title VII rather than on constitution, then also the eventual decision of the court would have remained same as the court would have taken into consideration the Equal Protection Clause of Constitution.
The court\'s decision in the given case is absolutely apt and valid as it will be very difficult to regulate that whether employment is given in any organization by taking into consideration the racial classification as a criteria. This would have led to filing of numerous lawsuits as there would have been dissenting opinions of people and it would be hard to justify the selection procedure. Also it would have been against the equal protection clause of the constitution, giving rise to litigation.
