In this case, Maxwell\'s Pic Pac had filed a mplaint against the state of Kentucky alleging that a provision of the state’s liquor control regulations violated the Equal Protection provisions of the United States and Kentucky Constitutions.
The Kentucky Revised Statute allowed other retailers to sell wine and liquor while prohibiting grocery stores and gas stations from doing so.
The case tells us that equal protection is important and irrational economic regulations cannot be formed at the cost of equal protection. All persons similarly situated should be treated alike. Business and equal protection should go hand in hand and all business and economic decisions should consider that all men are created and born equal and should be given equal respect under the law.
