If party A sees an ad of jeans on sale and goes to the store
If party A sees an ad of jeans on sale and goes to the store, picks a pair of jeans in his size and with a cash in his hands heads to the register. Party B counteroffers for the same jeans, can a manager sell the jeans to Party B or does he have valid contract with Party A?
Solution
There is no contract between party A and the manager on the basis of an Ad.
Advertisments are just a medium to publicize the products and does not constitute a contract. However, the terms are bound to be obeyed by the party making the Ad.
Manager is still offering what was advertisized, manager can sell the product to Party B.
However usually it is on first come first served basis and Manager should give the deal to Party A. However he is not bound to do so.
