Claim: A roulette wheel is fair and in 40 consecutive spins of the wheel, black shows up 23 times. (a roulette wheel has 38 equally likely slots of which 18 are black).

Solution

If the roulette is fair then there is fair chance to get 23 black shows out of 40. This event is not improbable. So according to the rare event rule, there is no reason to reject the caim that the roulette wheel is fair.
